Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT.

BY SIGNING THIS DOCUMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO CLAIM COMPENSATION OR SUE SHOULD YOU BE INJURED. PLEASE READ CAREFULLY!

TO: SUN SPORT RECREATION LTD. - RENTALS , and its directors, officers, shareholders, employees, guides, instructors, agents, representatives, contractors, subcontractors, successors and assigns (hereinafter collectively referred to as the “THE RELEASEES”)

DEFINITION – The Agreement shall apply to all activities, events, or services provided, arranged, sponsored or authorized by the Releasees, including but not limited to ice
fishing, snowshoeing and winter e-bike/ e-kart activities as well as general travel to Sun Sport rental items (Fishing huts)

ACKNOWLEDGEMENT – SAFETY & RISKS
I acknowledge that I have been advised of the inherent risks of Sun Sport winter rentals. I acknowledge the associated risks with being outdoors on the ice as it pertains to use of Sun Sport rentals

ASSUMPTION OF RISKS – I am aware that participation in the Activities involves risks, dangers and hazards including, but not limited to: slips and falls while on the ice or in Sun Sport fishing huts and retail premises.. I am aware of potential tripping hazards throughout the ice surfaces such as snow drifts and past ice fishing hole locations.

I am aware of the many motorized vehicles maneuvering over the ice and will avoid them at all costs. Renter responsibility to move safely around the ice surfaces and ability to avoid moving equipment over designated ice areas; Failure to is renter negligence. Equipment failure and accidents that occur while snowshoeing and on e-bikes/ e-karts may occur due to the obstacles and hazards, and terrain that may not have been well travelled. Renter is expected to dress in weather appropriate clothing and stay within the
approved operating areas to ensure Sun Sport representatives can locate them in the event of injury or rental issue.

I am aware that there are open holes within the fishing huts. I understand that these holes are potential tripping hazards and can result in hypothermia if the renter were to put a body part through the hole. I am aware they fishing lines and hooks can be hazardous and cause bodily injury and should be used with extreme caution. I understand that weather can change suddenly on the ice and although the fishing huts are heated I, the renter are responsible to dress for any/ all exterior weather conditions.

I am aware that the Ice is not properly lit at night. All assumptions of risks above are amplified at night. I assume all risks for failure to return to Sun Sport front office prior to
sunset.

I AM AWARE THAT ONE OF THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIES IS NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIES, SOME OF WHICH ARE
REFERRED TO ABOVE. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT - In consideration of the Releasees allowing me to participate in the Activities and permitting my use of their equipment, and for other good and valuable consideration the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

1. TO WAIVE ALL CLAIMS that I may in the future have against the Releases and TO RELEASE THE RELEASES ANY AND ALL LIABILITY from any loss, damage, expense or injury including death that I may suffer as a result of my participation in the Activities. DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT. R.S.B.C 1996, C. 337, ON THE PRT OF THE RELEASES AND INCLUDING THE FAILURE OF THE PART OF THE RELEASES TO SAFEGUARD OR PROTECT ME FROM THE RISK, DANGERS, AND HAZARDS REFERRED TO ABOVE.
